Creator Agreement
Effective date: December 1, 2026
This agreement is between you, the creator, and GamerSubs. It applies when you upload a game or earn money on GamerSubs, on top of the Terms of Service. You keep ownership of your game; GamerSubs gets the rights it needs to host and promote it, and keeps a platform fee on paid features.
Paid features (tips, in-game item purchases, game purchases and payouts) are currently in testing and not open to the public. The money sections apply once they launch.
1. Eligibility
You must be at least 18 and able to enter a contract. To receive money you need a connected Stripe account in good standing, and you must pass Stripe's identity checks.
2. You own your game
You keep all ownership of your game, its code, art, music and name. Nothing here transfers ownership to GamerSubs.
3. The license you give GamerSubs
While your game is published, you give GamerSubs a non-exclusive, worldwide, royalty-free license to:
- Host, store, copy and serve your game and its files.
- Let players play it on GamerSubs and through GamerSubs embeds on other sites.
- Show its title, description, thumbnails, GIFs, screenshots and short clips on GamerSubs and in GamerSubs' marketing and social media.
- Make technical changes needed to run it, such as compressing files or fixing canvas sizing, without changing its content.
When you unpublish or delete a game, this license ends, with two exceptions. Players who bought the game or its items can keep accessing them. Marketing already published, and copies in routine backups, don't have to be withdrawn.
4. Your promises
You promise that:
- You made the game or have the rights to everything in it, including third-party assets, engines, fonts and music, under licenses that allow commercial distribution.
- The game and its description are accurate and don't infringe anyone's rights.
- The game contains no malware, crypto mining, hidden tracking, or code that harms players or their devices.
- If your game collects any player data itself (for example its own saves, leaderboards or analytics), you'll follow the law, disclose it to players, and collect only what the game needs.
- You won't direct players to pay you outside GamerSubs for things sold through GamerSubs features.
5. Prohibited content
Games may not include:
- Sexually explicit content or nudity.
- Content that sexualizes or exploits minors in any way.
- Real-money gambling, or features that let players cash out winnings.
- Content that promotes terrorism, violence against real people, or hatred against protected groups.
- Stolen, pirated, or unlicensed games or assets.
- Scams, phishing, or anything that tricks players into giving personal or payment information.
Mature themes like cartoon violence are fine. Games intended only for adults aren't allowed until GamerSubs adds age verification and mature-content controls, which are coming soon. Once they launch, adult-only games must be labeled mature and will only be shown to verified adults. We may remove games or suspend creators that break these rules, with or without notice.
6. Fees
GamerSubs keeps a platform fee on each tip and purchase. Current fees, minimum prices and the payout minimum are listed on our Fees page, which is part of this agreement.
GamerSubs pays Stripe's card processing fees out of its own fee, so you aren't charged them separately.
We may change fees or minimums with at least 30 days' notice by email or on the dashboard. Changes don't affect payments made before they take effect.
7. Payouts
- With a connected Stripe account, your share of each payment goes to your Stripe balance shortly after the payment, and Stripe pays it out on its schedule.
- Earnings that can't go to Stripe immediately accrue to your pending balance on GamerSubs. You can request a payout once it reaches the payout minimum on the Fees page and your Stripe account is connected.
- Your dashboard shows each payment, its fee and your share.
- We may hold payouts while we investigate fraud, chargebacks, or a breach of this agreement.
8. Refunds and chargebacks
Players can get refunds under the Refund Policy. When a payment is refunded, your share is reversed and GamerSubs returns its fee too. When a player files a chargeback and wins, your share is deducted from your pending balance or future earnings. GamerSubs covers Stripe's dispute fees unless the chargeback came from your breach of this agreement.
9. Taxes
You are responsible for taxes on your earnings. Stripe may collect tax information from you and issue tax forms such as a 1099-K. Sales tax on purchases is coming soon and, once live, will be collected and handled on the platform side.
10. Ads
GamerSubs may show ads on the pages around your game. Revenue from those ads belongs to GamerSubs. Ad revenue sharing with creators may come later and will be added to this agreement if it does.
11. Removal and ending this agreement
You can unpublish or delete your games at any time; see section 3 for what continues for buyers. We may remove a game or end this agreement if you break it or the Terms, if we receive a valid legal complaint, or if we stop offering the Service. If we end it without cause, we'll pay out your remaining balance once it clears any pending refunds or chargebacks.
12. Liability
The disclaimers and limits of liability in the Terms of Service apply to this agreement. You agree to cover GamerSubs' reasonable costs from claims caused by your game, including claims that it infringes someone's rights.
13. Changes and contact
We'll notify you of significant changes at least 30 days before they apply. Questions: support@gamersubs.cloud.
